Terms of Service

1. Purpose

These Terms of Service (hereinafter "Terms") define the terms and conditions of use of the Scale Montage platform (hereinafter "the Service"), accessible at montage.scale-theme.com, operated by SAS MV GROUP, a simplified joint-stock company with a share capital of 10 euros, registered with the Sens Trade and Companies Register under number 991 674 805, with its registered office at 5B rue des Alouettes, 89100 Soucy, France.

By accessing and using the Service, you agree to these Terms without reservation. If you do not accept these Terms, please do not use the Service.

2. Description of the Service

Scale Montage is a video content management and automation platform for social media. The Service enables:

• Uploading and managing videos
• Connecting accounts on third-party platforms (TikTok, Instagram, YouTube, Facebook)
• Scheduling and automatically publishing videos to these platforms
• Tracking analytics and publication performance
• Managing account groups for simultaneous publishing
• Analyzing comments and trends
• Creating image carousels (static and video) via the Eragen module, including AI-assisted slide composition, AI image generation, conversational editing with an AI agent, and importing public carousels from third-party platforms as editable drafts

3. Registration and User Account

3.1. Account Creation

Using the Service requires creating a user account. You must provide accurate and complete information during registration (name, email address, password). Your password must be at least 8 characters long.

3.2. Account Security

You are solely responsible for the confidentiality of your login credentials and for all activities conducted through your account. In case of unauthorized use of your account, you must immediately notify Scale Montage at contact@scalemontage.com.

3.3. Account Deletion

You may request account deletion at any time by contacting our support. Deletion will result in the removal of all data associated with your account, including uploaded videos, social media connections, and publication history.

4. Third-Party Platform Connections

4.1. OAuth Authorization

The Service allows you to connect your accounts on third-party platforms (TikTok, Instagram, YouTube, Facebook) via the OAuth 2.0 protocol. By connecting an account, you authorize Scale Montage to access certain features of these platforms on your behalf, in accordance with the permissions granted.

4.2. Permissions Requested

Permissions requested during connection are limited to what is strictly necessary for the Service to function:

• TikTok: Video publishing, reading account information and analytics
• Instagram / Facebook: Content publishing, reading account information
• YouTube: Video uploading, reading channel information and analytics

4.3. Access Revocation

You may disconnect a third-party account at any time from the application settings. Disconnection results in the immediate deletion of stored access tokens. You may also revoke access directly from the settings of the relevant third-party platform.

5. User Obligations

You agree to:

• Use the Service in compliance with applicable laws and regulations
• Respect the terms of use of each connected third-party platform
• Not publish unlawful, defamatory, hateful, violent, pornographic, or rights-infringing content
• Not use the Service for spam, harassment, or manipulation purposes
• Not attempt to bypass technical or security limitations of the Service
• Not use bots, scripts, or automated means to access the Service outside of provided features
• Hold all necessary rights to the content published through the Service

6. User Content

6.1. Content Ownership

You retain all intellectual property rights to the content you upload and publish through the Service. Scale Montage does not claim any ownership rights over user content.

6.2. License of Use

By using the Service, you grant Scale Montage a limited, non-exclusive, and revocable license to store, process, and transmit your content to third-party platforms solely for the purpose of providing the Service. This license terminates upon deletion of the content or user account.

6.3. Content Responsibility

You are solely responsible for the content you publish through the Service. Scale Montage does not exercise any editorial control over user content and cannot be held liable for content published by users.

7. Plans and Pricing

The Service offers different subscription plans (Starter, Pro, Business), whose features and pricing are detailed on the Pricing page. Scale Montage reserves the right to modify its pricing at any time. Existing users will be notified of any pricing changes at least 30 days before they take effect.

The Starter plan is free and allows limited use of the Service. Paid plans offer advanced features and extended usage limits.

8. Service Availability

Scale Montage strives to ensure 24/7 availability of the Service. However, the Service may be temporarily interrupted for maintenance, updates, or force majeure. Scale Montage does not guarantee uninterrupted availability and cannot be held liable for service interruptions.

The proper functioning of the Service also depends on the availability and proper operation of third-party platform APIs (TikTok, Instagram, YouTube, Facebook). Scale Montage cannot be held liable for issues related to these platforms.

9. Limitation of Liability

The Service is provided "as is". Scale Montage cannot be held liable for:

• Direct or indirect damages resulting from the use of the Service
• Loss of data or content
• Actions taken by third-party platforms (account suspension, content removal, etc.)
• Issues related to third-party platforms or their APIs
• Non-compliance by the user with third-party platform terms of use

In any event, Scale Montage's liability is limited to the amount actually paid by the user during the previous 12 months.

10. Intellectual Property

The Service, its interface, design, logos, text, and all its elements are protected by intellectual property law. Any unauthorized reproduction, representation, or use of these elements is prohibited.

11. Eragen — Carousel AI Module

11.1. Scope

The Eragen module is an AI-assisted carousel creation feature included with the Service. The clauses below apply in addition to the general Terms ; nothing in this section limits your rights or obligations established elsewhere in these Terms.

11.2. AI-generated content

The Service uses third-party AI providers (currently OpenAI, fal.ai, Anthropic, MiniMax — see the Privacy Policy) to generate images, suggest text, and run a conversational editing agent. AI-generated outputs are provided as-is. You are responsible for reviewing AI outputs before publication and for ensuring they comply with the law (notably copyright, personality rights, and platform-specific rules). You retain ownership of the carousels you create through the Service, to the extent the underlying AI provider's terms grant that ownership.

11.3. Importing from URLs

The editor lets you paste public URLs (TikTok, Instagram, etc.) to clone them as editable drafts. By submitting a URL, you confirm that you have the right to reuse the imported content for your own creative purposes. You alone are liable for any subsequent use of imported content, including any infringement of the original author's rights or of the source platform's terms of service. Scale Montage may suspend the import feature for accounts that misuse it.

11.4. Content moderation

Images you upload to the Eragen editor are screened by an automated moderation gate (OpenAI moderation API) before they are stored. Content flagged for sexual content, violence, hate speech, self-harm, or other categories may be rejected without notice. The moderation gate is provided on a best-effort basis and is not a substitute for your own review.

11.5. Fair use of generation credits

AI image generation and agent calls consume real third-party API credits. Plans may set monthly limits on generation and agent usage ; once a limit is reached, the corresponding features are paused until the next billing cycle or until a paid top-up is purchased. Scale Montage may rate-limit accounts engaged in abusive or automated usage patterns.

12. Changes to These Terms

Scale Montage reserves the right to modify these Terms at any time. Users will be notified of changes by email or in-app notification. Continued use of the Service after notification constitutes acceptance of the new Terms.

13. Termination

Scale Montage reserves the right to suspend or terminate a user's access to the Service in case of violation of these Terms, without prior notice or compensation. Users may terminate their account at any time by contacting support.

14. Governing Law and Jurisdiction

These Terms are governed by French law. In case of dispute, the parties agree to seek an amicable resolution. Failing that, the competent courts of Sens, France, shall have exclusive jurisdiction.
